Terms and Conditions

These terms govern your use of the LangNation student portal and the language courses booked through it. Please read them before requesting an account.

Plain summary. You may withdraw from a course within 14 days of booking and get your money back. All course materials and LangNation notes remain our property — use them for your own study and share them with your classmates or other LangNation students, but never sell them or publish them outside the school. Your account is personal to you. We handle your data under the GDPR and never sell it.

This summary is for orientation only; the numbered clauses below are what apply.

§ 1 Scope

These General Terms and Conditions apply to all contracts concluded between LangNation ("we", "us") and you for language courses, examination preparation and use of the student portal at langnation.com.

Differing conditions of your own do not form part of the contract unless we have agreed to them in writing.

A consumer is any natural person entering into the contract for purposes outside their trade or profession. An entrepreneur is a person acting in the course of their trade or profession. Several clauses below apply only to consumers, and say so.

§ 2 Provider

The provider of these services is the company named in our Imprint, which also gives our postal address, contact details and, where applicable, our register entry and VAT identification number.

§ 3 Formation of contract

The presentation of courses on this website is not a binding offer. It is an invitation to you to make one.

By submitting a booking you make a binding offer to enter into a contract. We may accept it by written confirmation, by email, or by beginning to provide the course. A contract comes into being only on our acceptance.

We are not obliged to accept a booking. If we do not, any payment already made is refunded in full without delay.

§ 4 The student portal account

An account is granted on request and at our discretion. It is intended for people studying with us or intending to.

  • Your account is personal. Do not share your password or let anybody else use your account.
  • Tell us without delay if you believe someone else has gained access.
  • You are responsible for what happens under your account until you tell us.
  • We may suspend or close an account that is misused, or where the information given was false.

You may close your account at any time by asking us. Closing an account does not by itself end a course contract, and does not affect fees already due.

§ 5 Our services

The scope of each course — level, duration, number of lessons, format and materials — is as described on the course page at the time you book.

Courses are taught online unless stated otherwise. You need a suitable device, a stable internet connection and a headset; these are your responsibility, not ours.

We may change the teaching staff assigned to a course. We may make minor changes to timetable or content where reasonable for you, for example to accommodate a public holiday.

We do not guarantee that you will pass any particular examination. Examinations are set and marked by the examining bodies, not by us.

§ 6 Prices and payment

Prices are those shown at the time of booking and are stated in euro. Where you are a consumer, prices include statutory VAT if applicable.

  • Fees fall due on booking unless the course page states otherwise.
  • Where instalments are agreed, each falls due on the date agreed.
  • If payment is late we may, after reminding you, refuse further access to the course until it is settled. Statutory rights to default interest remain unaffected.
  • Bank charges for transfers from outside the SEPA area are yours to pay.

Not attending lessons does not reduce the fee.

§ 7 Right of withdrawal for consumers

Withdrawal policy. You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day the contract was concluded.

To exercise it, inform us by a clear statement — a letter sent by post, or an email — that you are withdrawing. You may use the model withdrawal form, but you do not have to. It is enough that you send your notice before the period expires.

Effects. If you withdraw, we refund all payments received from you without undue delay and within 14 days of being informed. We use the same means of payment you used, unless you expressly agree otherwise; you are not charged any fee for the refund.

Early start. If you asked us to begin the course during the withdrawal period, you owe us a proportionate amount for what was provided up to the point you withdrew, measured against the full scope of the contract.

The right of withdrawal expires early once the service has been provided in full, where we began with your express consent and you acknowledged that you would lose the right on full performance.

For downloadable digital content, the right expires once the download begins, where you have expressly consented and acknowledged the loss of the right.

§ 8 Cancellation and changes by you

Beyond the statutory right of withdrawal, you may cancel a course by giving us notice in writing. Any fees already earned by lessons delivered remain payable. Where we can still fill your place, we will refund what is reasonable in the circumstances.

Requests to move to a different course or start date are granted where places allow.

Cancellation must be in writing — email is sufficient. A verbal cancellation to a teacher is not effective.

§ 9 Cancellation by us

We may cancel a course that does not reach its minimum number of participants, or where a teacher is unavailable and no substitute can be arranged. In that case you get a full refund of anything paid for lessons not delivered, or a place on an equivalent course if you prefer.

Individual lessons that we cancel are rescheduled or refunded.

§ 10 Your obligations

  • Give accurate information when booking, and tell us if it changes.
  • Attend punctually and behave courteously towards teachers and other participants.
  • Do not record, photograph or stream a lesson without the express consent of everyone taking part.
  • Do not use our services for anything unlawful.

We may exclude a participant whose conduct seriously disrupts teaching. Where the fault is yours, the fee remains payable.

All course materials, LangNation notes, scripts, recordings, worksheets and mock examinations remain the property of LangNation or of their respective authors. Nothing in the course fee transfers ownership or copyright to you.

What you may do. You receive a simple, non-exclusive and non-transferable right to use the materials:

  • for your own study, during the course and afterwards, without time limit;
  • to share them with classmates in your own course;
  • to share them with other LangNation students — that is, internally, among people enrolled with us.

What you may not do. You may not, whether for payment or free of charge:

  • sell, licence, rent out or otherwise commercialise the materials;
  • publish them, upload them to any website, file-sharing service, cloud drive, messaging group or social platform open to people outside LangNation;
  • pass them to another school, tutor or training provider;
  • remove or alter any notice of authorship or ownership;
  • use them to teach others commercially.

Sharing among LangNation students is permitted precisely because studying together helps; putting the same files where anyone can reach them is not, and is what this clause exists to prevent.

A breach entitles us to exclude you from the course without refund and to pursue the remedies copyright law provides. Where materials were shared beyond the permitted circle, we may require you to remove them and to tell us where they went.

§ 12 Liability

We are liable without limitation for injury to life, body or health caused by our negligence, and for damage caused intentionally or by gross negligence.

For slight negligence we are liable only where an obligation is breached whose fulfilment makes proper performance of the contract possible at all and on which you may reasonably rely (a cardinal obligation). In that case liability is limited to the damage typical of this kind of contract and foreseeable at the time it was made.

Liability under the Product Liability Act and under any guarantee we have given remains unaffected.

We are not liable for interruptions caused by your own equipment or internet connection.

§ 13 Data protection

We process personal data in accordance with the GDPR and German data protection law. What we collect, why, how long we keep it and what rights you have are set out in our Privacy Policy.

We do not sell personal data and do not pass it to third parties except where necessary to provide the service or where the law requires it.

§ 14 Changes to these terms

We may amend these terms where there is a valid reason, for example a change in the law or in our services. We will tell you at least six weeks before a change takes effect.

If you do not object in writing before the change takes effect, it is treated as accepted; we will say so expressly in the notice. If you object, either party may terminate the contract at the point the change would take effect.

§ 15 Dispute resolution

The European Commission provides a platform for online dispute resolution at ec.europa.eu/consumers/odr.

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.

§ 16 Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Where you are a consumer habitually resident in another EU state, you keep the protection of any mandatory provisions of that state's law.

Where you are an entrepreneur, a legal person under public law or a special fund under public law, the place of jurisdiction is our registered office.

Should any provision be or become invalid, the remainder stays in force.

Version: these terms apply from the date shown on this page. The version in force when you booked is the one that applies to your contract.
